An Industry 'Common Practice' is Being Argued

The Fair Labor Standards Act (FLSA) dictates much about how and when employees are paid. The Supreme Court is deciding a significant case that could impact many employers that have industry 'common practices' related to pay and compensation.

A supervisor in the oil and petroleum industry who earns over $200,000 a year and has been classified as exempt under the 'Highly Compensated Executive' exemption is claiming that he was misclassified and is owed overtime.

The decision seems to be between whether a guaranteed weekly rate or a predetermined wage, be it daily or any other unit, is the threshold.
